In 1395, there was a complaint by Sir William Fitzwilliam, Lord of Emley, that Sir Nicholas and others broke into his park at Emley and hunted without licence. He remained unmarried and died without heir. On 13 September 1408 at Thorp near York the administration of his estate was given to his brother Richard "..because Nicholas Burdet, Esquire, of Denby in the diocese of York has gone the way of all flesh without making a will." A confirmation of the bond was signed on 4 October 1486. This land dealing was to be significant as the the Burdet and Rich families were to intermarry later (Aymer Rich married Alice Budet in 1587) and the land around Bullhouse was to be important well into the 19th and 20th centuries as a place for non-conformist worship and indelibly linked to the Rich family. On 6 February 1486, Richard made a grant with warrant to his son and heir apparent that after his death Richard would inherit Denby, Ingbirchworth, Smallshane, Bilcliffe, Barnby, Barnsley, Mapplewell, Darton, Kexborough, Hoyland, Bretton, Clayton, Skelmanthorpe, Cumberworth and Bagden. Vellum : one skin 91 X- 31, two small seals of red wax, one bears the initials I.B and the other is obscure. (1486-7) January ?th, in the 2nd year of Henry VII. A lease recoreded that Ralph Burdet, Gent, was granted land by William Hewet, a merchant and citizen of London, for 21 years at 40 marks per annum rent with the proviso that Ralph could not fell ashwood or oak trees. Sir Richard and his heirs continued to live around Lowesby, Leicestershire until about 1450 when Elizabeth Burdet, the heir to the Burdet name, married Sir Humphrey Stafford MP. Charters for the holding of markets still remain. On 23 August 1301 a charter to hold a market on Wednesdays at his manor in Lowesby was granted by King Edward I to William Burdet and on the same day he was granted a charter to hold a market at his manor on the feast of St. Michael (29 September) and on the Feast of St. Philip and St. James (1 May). Court Rolls survive which show his legal and financial dealings in High Hoyland in 1418 and 1419. In his Will dated 21 June 1436 he left £20 to his daughter Margaret as a marriage portion. He died about 1546 in Denby, Yorkshire. On 12 May 1522, the Normanvilles handed back their lands to Richard, who at this time would have been living in relative luxury and security but all this was to change. In 1528 there was an agreement that the annual rent of 5s would be given to him by William Blackburn, yeoman, formerly of Huddersfield, from messuages and lands of Blackburn's in Huddersfield. On 27 April 1535 when Aymer, his son, was 38 and heir apparent to his father's vast estate, he was involved in a riot at Birthwaite. Henry VIII was on the throne and had become head of the Church of England. Earlier in that year he had executed Sir Thomas More and left Catholics fearing for their lives. Aymer's testimony to the Star Chamber still exists. He denied any part in the riot but accepted that there was a problem about the ownership of the land. Late in 1535 Richard was accused of treason by his son Aymer. This was probably because Richard was still a secret Catholic and Aymer thought that this would be a quick way to inherit his lands. The north of England had never been fully reconciled to Tudor rule. Under pressure of changing trade patterns, falling wages and the enclosure movement, discontent grew in the early sixteenth century until the religious changes of the 1530s brought the doctrinally conservative predominantly Roman Catholic region to rebel in October 1536. Perhaps just in time, in October 1536, Richard was pardoned by by Henry VIII. "Pardon. Henry VIII to Richard Birdet of Denby Esq., alias Richard Burdet of Howland Esq., for all offences and rebellions, insurrections, misprisons etc." Richard promised himself and his dependants in the King's service at need in Lord Darcy's command. Within weeks an army of about 30,000 armed northerners was camped at the River Don, prepared to march south. Henry broke his promises to meet some of the rebels' demands if they disbanded and ruthlessly suppressed fresh outbreaks of rebellion in 1537. After 1536, the dissolution of the larger monasteries and the reassigning of lands by the King to his loyal supporters, caused more religious discontent. The great Progress to the North in 1541, when Henry VIII and a huge entourage moved from London via Lincolnshire and Hull to York, was probably attended by Richard Burdet. Towards the end of his life Richard still felt hatred towards his heir, Aymer, and he decided that his second son, Thomas, should inherit all the property and mills except High Hoyland which was left to Aymer. The Yorkshire Feet of Fines record that in 1541 Thomas received "the Manors of Denby and Holland and 17 messuages with lands, a watermill and 2 fulling mills in Denby, Holland, Little Breton, Clayton, Durtcar, Byrcheworthe, Mapellwell, Bylclyff, Thurlston, Cumberworthe, Cafforth-hyll, and Darton, which, after the death of Thomas Burdett, remain to Roger, his brother, and his lawful male issue, and failing such, after his death, to Philip Burdett, another brother of Thomas, and his lawful male issue, and failing such, after his death, to Alice, Isabel, Grace, Dorothee, and Elizabeth, daughters of Richard Burdett." Richard died in 1546 and left: 17 homes with outbuildings, 1200 acres of land, 550 acres of meadow, 4000 acres of pasture 1200 acres of wood, a water mill, two fulling mills, £9 10s rent. Unsurprisingly the two brothers were at odds over their fathers will. Both had powerful father-in-laws to negotiate the most advantageous deals for them. Thomas preferred Birthwaite to Denby and, to resolve the situation, Aymer agreed to pay his brother a bond of £1000 - a huge sum of money. Richard BURDET was born about 1555 in Denby, Yorkshire. He had legal problems in 1589. The Court of the Duchy of Lancaster Chamber heard Pleadings, Depositions and Examinations in the case of Wortley and Clayton v. Burdett about lands in Denby and Cumberworth: York. He granted fees in 1606. Grant in fee simple by Ric Burdet of Denbie Hall, Esq and George Burdet, his son and heir apparent to Francis Burdet of Birthwait, Esq of all their common, moor and waste ground in Cumberworth. The following year more land deals were recorded "Gift in fee simple by Francis Burdet of Birthwayt, esq to Richard Burdet of Denbyie hall, esq, and George Burdet his son and heir apparent of those several parcels of common known as 'Cliffe or 'Harcliffe' within the lordships or townships of Cumberworth." He had financial problems in 1610. Richard Burdet probably had large debts inherited from his father. On Henry's death, the financial problems for the Manor of Denby were compounded by Henry bequeathing all his wealth to his nine illegitimate children, although he was powerless to settle the lordship on them. Thus when his legitimate heir, Richard Burdet, became the Lord of the Manor of Denby he had the title but very little money. He signed a will about 1616 in Denby, Yorkshire. Apart from the main bequest to his son and heir, George, Richard left his son, Bosville, 10s; Thomas Wheatley, his late daughter Dorothy's husband, 12d; his daughter Mary Green 2s 6d; to his wife and his daughters Joan and Arabella he left the rest of his goods to be divided between them. This lease shows that Richard was a Gent. and a further lease dated 24 June 1611 shows Richard paying £30 to Thomas Waterton and a further £30 on 19 December 1611 for "closes of 12 acres arable, meadow and 8 acres pasture in Cawthorne called Kettle Royd" which Richard was already using. He was the recipient of a Bond dated on 8 May 1616. The Bond stated: "William Field of Carhead, Yorkshire, gent, to Richard Burdett of Carhead, Yorkshire, gent, tithes of corn and grain from a messuage at Carhead, now in the possession of Richard Burdett, and all arable lands and meadows belonging to this messuage, in Hewland als. Hewland swaine als Hoyland swaine, parcel of the rectory of Silkstone, Yorkshire, part of the late dissolved monastery of Pontefact." He was the recipient of a Bargain and Sale on 1 May 1617. The Bargain and Sale stated: "William Field of Carhead, Yorkshire, gent, to Richard Burdett of Carrhead, Yorkshire, gent, tithes of corn and grain annually arising from a messuage at Carrhead." He was the recipient of a Bargain and Sale on 27 Dec 1617 in Carr Head, Hoylandswaine, Yorkshire. The Bargain and Sale stated: "Samuel Wortley of Swinton, Yorkshire, gent, to Richard Burdett of Carhead, Yorkshire, gent, "tithes of hay, wool and lamb arising from the capital messuage or farm called Carhead, situated in Hoylandswaine, par. Silkstone, and all lands ajoining; one little meadow; 2 closes called Green Leyes; 1 close called Calf Close; 1 little spring wood called the Carr Spring; 1 close called Healdinge Close; 2 closes called Oxclose and Norcroft; 1 close called Walkeringe and Walkeringe Springe; 2 closes called West Crofts; 2 closes called the Scoutroyds; 3 closes called the Batles; 1 close called the Slowgreave; closes called the Newclose, Kebinge and Crossefield, parcel of the rectory of Silkstone". He left Cannon Hall at this time and was known from then on as Richard Burdet of Carr Head as a confirmation of a grant dated 14 June 1623 shows He confirmed a grant on 14 Jun 1623. The grant stated "Richard Burdet of Carhead, Yorkshire, gent, to Richard Burdet of Highley, Yorkshire, gent, and Mary Burdet, daughter of Richard Burdet of Carhead. All his goods and chattels, provided that he pay 12d. in 3 years time, in order to make void the estate of tithes previously made to the use of Mary Burdet, and provided also that he can continue to live at Carhead." He appointed attornies in Jun 1624. "Richard Burdet of Carhead, Yorkshire, gent, confirms that he has appointed William Wordsworth of Scholehill, and Rauf Wordsworth of Waterhall, Yorkshire, yeoman, his attornies, to recover from Thomas Hanson of Thurgoland, Yorkshire, gent, £20." The problems concerning the dealings with Thomas Hanson continued and on 25 February 1639 there is a ratification of a deed which states "Samuel Wortley of Swinton, Yorkshire, gent, confirms that by a previous deed of 27 Dec 1617, he sold the tithes of Carhead, in Hoylandswaine to Richard Burdett. Now, at the request of Mary, daughter and heir of Richard and Thomas Hanson, assignee of Richard Burdett, Wortley confirms that the tithes are to be held to the use of the heirs and assigns of Richard." and in 1647 there was a bill for the "case of Thomas Hanson of Carhead, Yorkshire, yeoman versus Richard Burdett, then of Carhead concerning tithes of hay, wool, lamb, corn and grain, issuing from the capital messuage of Carhead." He sold Carhead on 5 Oct 1652. Carhead was sold to Thomas Walshaw (of Horbury) on 5 October 1652. The Confirmation of a Bargain and Sale of that date stated: "Capital messuage in Hoylandswaine, called the Carhead, together with all the buildings and lands adjoining called: the Inge; the Greenefield; the Heald; the Lamb Close; the Calve Close; the Calf Close spring; the Ox Close; the Rough Close; the Whitefield and Springwood; the Acre; the New Field sometime divided into two parts, with the building or decayed cottage in the Slowgreave; the Kebane and Keb Ing, sometimes divided into 2 parts; the Half Acre lying in a close called the Lathecrofte; one parcel of land lying on the north side of the fold of John Sotwell and John Couldwell, and butting east on the common, west on a little hillock near John Couldwell's ing, and south, on a parcel of John Couldwell's land". He died about 1656 in Carr Head, Hoylandswaine, Yorkshire. A document dated June 1656 shows a "bargain and sale with feoffment. William Shaw of Penistone, Yorkshire, fellmonger, and Mary, his wife, daughter and heir of Richard Burdet, late of Carr Head, gent, deceased.... to John Sotwell of Cathill, Yorkshire, gent and Thomas Walshaw of Carr Head, yeoman. Tithes of corn, grain, hay, wool and lamb and all other tithes isuing from the capital messuage called Carr Head, lying in Hoyland Swaine, parish of Silkstone". Parents: Ralph BURDET and Barbara FOLIJAMBE. Spouse: Barbara (Barbary) WORDSWORTH. Richard BURDET and Barbara (Barbary) WORDSWORTH were married on 12 Jun 1619 in St John the Baptist Church, Penistone,Yorkshire. Children were: Mary BURDET. Richard BURDET was born about 1610 in Carr Head, Hoylandswaine, Yorkshire. The difficulty with untangling the ownership of Carr Head is doubled because there were two Richard Burdets (cousins) born around the same time who both lived at Carr Head! He was christened on 16 Jul 1610 in St John the Baptist Church, Penistone,Yorkshire. He was the beneficiary of a Bond dated on 18 Dec 1613. The Bond stated: "William Field of Thurnscoe Grange, Yorkshire, gent and Henry Otley of Thurnscoe, Yorkshire, yeoman, are bound to Edward Sotwell of Cathill, Yorkshire, gent, in £40, to pay to Richard Burdett, son of Jane Burdett of the Carhead, Yorkshire, widow, £20, at age 21." He was listed in the Hearth Tax Returns about 1672 in Hoylandswaine, Yorkshire. He had three hearths. Parents: George BURDET and Jane SOTWELL. Richard BURDET was born about 1610 in Denby, Yorkshire. He died about 1661. In 1640 when Richard inherited from George the family fortunes had reached a very low ebb and he could not afford the payment to Birthwaite except by using the money from the sale of Denby Hall. He then acquired new lands at Austerfield, near Doncaster, and went to live there. On 2 March 1639 Richard Burdet of Denby Hall sold Walkmilnebank and Landclose in Denby and a tied messuage called Creswick in Ecclesfield to John Senior of Masbrough. On 1 April 1652 Richard received a third part of estates in Westlyn, Northlyn and Clench Wharton from Walter Stonehouse junior. Richard was still a man of means and in his Will he left his wife Ellen £60 per year for each year of her natural life. To Martha and Sarah he left £200 each and to his sister Dame Mary Beaumont he left £5 to buy her a ring as was usual. Parents: George BURDET and Sarah BROWNE. Spouse: Margaret EYRE. Richard BURDET and Margaret EYRE were married about 1630. Children were: George BURDET, Robert BURDET. Spouse: Ellen UNKNOWN. Richard BURDET and Ellen UNKNOWN were married before 1649. Children were: Richard BURDET, Henry BURDET, Martha BURDET, Sarah BURDET. Richard BURDET was born about 1649 in Austerfield, Yorkshire. He died about 1673. He was buried about 1673 in Sandal, Wakefield, Yorkshire. Richard was only around 24 years old when he died. In his will he describes himself as of London and a gent. He left £400 to Thomas (his nephew born 1665). Parents: Richard BURDET and Ellen UNKNOWN. Robert BURDET. Parents: Francis BURDET and Elizabeth ROCKLEY. Robert BURDET. Parents: Sir Francis BURDET Bt and Frances STEPHENSON. Robert BURDET leased land in Ingbirchworth in 1441. The lease for 38 years was " by Robt Burdett of Denby, esq, to Wm Turton the elder and John his son of 7 oxgangs of land in Yngbyrcheworth lately held by the said Wm of Ric Burdett father of the said Robt; at an annual rent of 32s." He died about 1451 in Denby, Yorkshire. He was buried about 1451 in St John the Baptist Church, Penistone,Yorkshire. In his Will dated 24 June 1451, he left 24s each to his daughters Joan, Agnes and Elizabeth and for the expenses on the day of my burial 20s for bread, ale and cheese. An addendum was added recording that he owed £20. Parents: Richard BURDET and Joan STORPE. Spouse: Unknown BRADBOURNE. Robert BURDET and Unknown BRADBOURNE were married. Children were: Aymer BURDET, Joan BURDET, Agnes BURDET, Elizabeth BURDET. Robert BURDET was born about 1272 in Lincolnshire. Robert was the first of the Burdets to settle at Denby. He became Lord of the Manor of Denby via a bequest from Idonea's father. In 1297, he represented his family in London at the Court of the Arches, noted in the Curia Regis. This was a dispute about the presentation of the chaplain at Rand Church. Robert Burdet was vindicated. Surviving records show that from this time onwards the evidence of the lineage is strong.
