1. Thomas WALSHAW was born about 1610 in Horbury,
Wakefield, Yorkshire. He bought land between 1652 and 1656 in Carr
Head, Hoylandswaine, Yorkshire. A Deed of 26 Jun 1652 showed Thomas'
dealings with Carrhead. " William Gower of Morton Corbet, Salop, clerk,
and Thomas Hanson of Eastfield, Yorks., yeoman, agreed to the sale of a messuage
in Hoylandswayne to John Sotwell and Thomas Walshawe, for £800; the sale
of 1 Oct 1652; a final concord of Trinity term 1652; deed of agreement of 14
Dec 1652 by which the parties agreed that the lands should be divided into several
parts."
A Bond dated 1 Oct 1652 shows that Thomas lived in Horbury " William Gower
of Acton Reynold, Salop, clerk, is bound to John Sotwell of Hoylandswayne, Yorks.,
gent., and Thomas Walshaw of Horbery, Yorks., yeoman, in £1,600 to keep
the covenants of a deed of equal date".
Confirmation of a bargain and sale for Carrhead made on 5 Oct 1652 "William
Gower of Acton Reanald, Salop, clerk to John Sotwell of Cathill, Hylandswayne,
Yorks., gent and Thomas Wallshaw of Horbery, Yorks., yeoman.
A Copy of a deed showed that Thomas had moved to Carrhead by 28 Apr 1653
"Of Acton, Salop, clerk, of the first part; John Sotwell of Hoylandswayne,
Yorks., gent., and Thomas Walshaw of Carrhead, Hoylandswaine, Yorks., yeoman,
of the second part: Richard Elmehirst of Houndhill, Worsbrough Dale, and Raphe
Wordesworth of Waterhall, Penistone, Yorks., gents.,The parties agree to levy
a fine in the manors of Penistone and Hoylandswayne, and in all buildings and
lands belonging to the manors; in a messuage in Hoylandswayne called Houlme House,
and in another messuage in Hoylandswayne called the Carrhead."
A Deed of partition, by means of bargain and sale dated 29 Mar 1656 shows
that Thomas bought part of Carrhead "For £30, John Sotwell of Cathill,
Yorks., gent., to Thomas Walshawe, of Carhead, Yorks., yeoman, a moity of Carhead
messuage, and all lands and buildings, and, Walshaw will occupy the following
closes; the Inge, the Heald, the Greenfield, the Lame close, the Lame close spring,
the Little Westcroft, the Great Westcrofte, the Calf Close, the Wood Batelis,
the Nether Wood Batleis, the Ox close, the Rugh close, an acre and a rood in
the northwest end of the Whytefield, and all the wood and the wasteground in
the above closes, and in the north west part of the Scout Royd."
There was obviously a problem with the tithes as, on 7 Jun 1656 " William
Shaw of Peniston, Yorks., fellmonger, and Barbary Burdett of Penistone, widow,
are bound to John Sotwell of Cathill, Yorks., gent., and Thomas Walshaw of Carhead,
Yorks., yeoman, in £50, to keep the covenants of a deed of equal date."
"William Shaw of Penistone, Yorks., fellmonger, and Mary, his wife, daughter
and heir of Richard Burdet, late of Carhead, gent., dec'd., and Barbary Burdett,
widow, late wife of Richard Burdett, to John Sotwell of Cathill, Yorks., gent.,
and Thomas Walshaw of Carhead, yeoman. Tithes of corn, grain, hay, wool and lamb,
and all other tithes issuing from the capital messuage called Carhead, lying
in Hoylandswayne, par. Silkstone."
On the same date a Bond records "William Shaw of Penistone, Yorks., fellmonger,
and Mary, his wife, and Barbary Burdet of Penistone, widow, to John Sotwell of
Cathill, Yorks., gent., and Thomas Wallshaw of Carhead, Yorks., yeoman. Bond
made between William Field, late of Carhead, yeoman, dec'd., and Richard Burdett,
late of Carhead, for £40, to enable Sotwell and Wallshaw, to better enjoy
tithes of corn, and grain issuing out of Carhead messuage, against the heirs
of William Field." It appears that there were two Thomas Walshaws living
in the area. Records of the Burdet family show that Carrhead and its tithes were
attributed to Richard Burdet (b.1589 Denby) and that he sold the property and
the rights to its tithes in 1652 to Thomas Walshaw of Horbury.
