55. Alice BURDET was born about 1570. After her mother's death Alice went to live with her father and Dowsabell at Walton. She died on 21 Jul 1651 in Penistone, Yorkshire. She was buried on 21 Jul 1651 in St. John's Church, Penistone, Yorkshire. "Sepulti Alicia uxor Emoris Rich, Gen. "

Alice BURDET and Aymer RICH were married on 15 May 1587 in Almondbury, Huddersfield, Yorkshire. They obtained a marriage settlement on 24 Jul 1598 in Penistone, Yorkshire. On 24 July 1598, in consideration of her marriage (already solemnised) Alice was given property around Penistone (Smallshaw and Royd) as well as property in Thurlstone and Milnhouse as her settlement. In Thurlstone this included one fulling mill and one corn mill with a yearly rent of 13s and a messuage called Bullhouse with lands and a water corn mill. On 9 October 1611 the property at Smallshaw was itemised as Alice's nephew, George, had issues about the lands namely ten messuages, four cottages, one water mill, one water fulling mill, fourteen gardens, four hundred acres of land and 13s 4d rent charge in Smallshaw and Royd for £400. "William Riche of Bollows in Thurlestone to Francis Greave of Hunshelf and William Hinchcliff of Bilcliff, in consideration of the marriage already solemnised between Aymer Riche (one of the sons of Edward Riche son and heir of the said William) and Alice Burdett (one of the daughters of Henry Burdett of Walton), the manor of Smallshaie and capital messuage called Smallshaie and appurtenances in Smallshaie, Thurlestone & Thurlestone meare and the capital messuage called Roide and the capital messuage called Milnehowse and fulling mill and one water corn mill in Thurlestone with a yearly rent of 13/- out of several lands in Thurlestone (all lately purchased of Richard Turton of Pickeringe) and the capital messuage called Bollowes with lands, etc. and a water corn mill at Bollows in order that a fine may be levied, settling the estate on William, Edward and Aymer Riche in succession, with reversion to Richard Riche, brother of Aymer, in default of issue, also it is agreed that a settlement may be made on Alice of the Smallshaie and Milnhouse property for her jointure."
An agreement "to levy a fine on the manor and capital messuage called Smallshaw and the other disputed property" was recorded on 25 October 1611 between Aymer Rich and George Burdet of Denby Hall. The lands were "to the use of Aymer Rich". The matter rumbled on and had to be settled on 5 October 1627. Aymer Rich, his wife Alice and their son William and his heirs had the land in perpituity. It appears that George Burdet was trying to assert his influence as Lord of Denby.
Aymer RICH was born about 1565 in Penistone, Yorkshire. He was the son of Edward Rich and Elizabeth Turton. He had property dealings between 1598 and 1614 in Penistone, Yorkshire. Aymer Rich and his brother Richard Rich were mentioned in a deed dated 5 Feb 1609/10 at Eckland, Penistone. Deed of partition: "Aymor Rich of Bulhouse and Richard Rich of ? divide one messuage in Eclande in the parish of Penistone which they purchased jointly of Robert Brownell of Derby."
Amor Rich's use of the property Agreement to levy a fine: "Aymor Rich of Bullhouse, George Burdett of Denby Hall and John Wordesworth of Softley agree that Aymor Rich shall levy a fine of the manor and capital messuage called Smallshaw in Thurlestone, messuage called Bullhouse and water corn mill, other messuages called Roid, Milnehouse, with a fulling mill, Catshaw and Langfield and a rentcharge of 13/4 to the use of Aymor Rich."
Exemplification of final concord: "George Burdett and John Wordesworth plaintiffs v. Aymor Rich, deforciant - the manor of Smalshaw, parish of Penistone, 10 messuages, 4 cottages, 1 water corn mill, 1 water fulling mill, 14 gardens, 400 acres of land etc., and 13/4 rent charge in Smalshaw and Roid for 400 pounds." He died about 1652 in Penistone, Yorkshire. He signed a will on 18 Jul 1652 in Bullhouse, Thurlstone, Yorkshire. "In the name of God Amen the Eighteenth day of July AD 1652 Aymor Rich of Smallshaw in the parish of Penniston and county of York; being in good health of body and of good and perfect memory, Gods name be praised therefore and desirous to dispose of my worldly Estate now in my health, All former wills by me heretofore made disallowed and revoked, I do make this my last will and testament in manner and form following, First I bequeath my Soul to God hoping assuredly to be saved by the death and passion of Jesus Christ, And my body to the Earth from whence it came, to be disposed at the discretion of my executors hereafter named;
I give unto Silvanus Rich my grandchild all my houshold goods and husbandry geer at Bull house if any be,
I give unto my son Daniel Rich all my houshold goods that I have at Smallshaw (if any be ...) and my will is that if the said Silvanus Rich my grandchild his heirs and assigns shall have hold and enioy peacably and quietly all and every part and parcel of the lands and tenements with the appurtenances which I have given unto him the said Silvanus Rich without suit trouble claim or molestation to be made by Daniel Rich my grandchild son of Edward Rich my eldest son deceased, or by any of the children of the said Edward Rich or by any other person or persons by through or under them or any of them, or by the procurement of them or any of them That then the said Silvanus Rich shall pay out of a Bond if he hold and enioy the said Lands quietly without suit claim or trouble the sum of £100 within five years next after my decease, making the said Silvanus & his heirs and assigns such discharge and discharges and release of all titles or any other assurance as by his Councel learned in the Law shall be thought fit And for want of such discharge the money to be unpaid, the money to be divided in manner as followeth.
To the Children of Edward Rich my eldest son viz to Daniel Rich £50, to the Children of Amor Rich £10, To Mary the wife of Stephen West £10, To Martha which is widow Greene £10. To John Rich £10. To Hellen Rich £10.
I give unto Silvanus Rich my grandchild and his heirs for ever, all my deeds indentures wills and all my writings whatsoever which I give to my executors hereafter named
The rest of my goods not bequeathed I give to the said Silvanus Rich and Daniel Rich my son and I make them Executors of this my last Will and Testament.
In witness whereof I have hereunto set my hand and seal the day and year above written. Amor Rich. Sealed and published in the presence of William Rich Reginald Appleyard."
His Will was proved on 9 August 1652 at the Prerogative Court of York. Aymer came from a long line of men who had lived at Bullhouse near Penistone. His 3x great grandfather, William, had bought Bullhouse from Thomas Appleyard in about 1405 and there had been a dealing about the land between the Nicholas Burdet and the Robert Rich (William's grandson and Aymer's great great grandfather) on 8 October 1453. Aymer had one brother, Richard, "of the Royd".
Aymer was the Chief Constable of Staincross Wapentake in 1624. Alice BURDET and Aymer RICH had the following children:

William RICH was born about 1599 in Bullhouse, Thurlstone, Yorkshire. He served in the military between 1642 and 1644. He was Captain of Horse in the Parliamentary Army. His commission as Captain of a troop of horse in the regiment commanded by Colonel Laurence Parsons, was signed by Ferdinando Lord Fairfax, 22 June 1644.
William lived at Bullhouse and, as Adam Eyre (owner of the adjoining estate Hazlehead) writes in his famous diary, he made frequent visits to his friend William Riche of Bullas. They appear to have been brother officers in the Parliamentary Army.
" A Dyurnall, or catalogue of all my accions & expences from the 1st of January 1646/7. Adam Eyre:
Jan 13. In the afternoon I went to Bullos to speak to Captaine Rich & met him in the Oxclose; and so home again
Jan 14. Pm. Robin Cook came in to us I committed him prisoner & beat him in the presence of Capt Rich, Edward Hinchcliffe, Jo. Micklethwaite, Nich. Greaves, Jo. Cooke, Dan. Rich of Millhouse, & divers others….
Jan 18. To Penistone, this day I gave Amor Rich to carry to my cos. Rawson, Ed., of Walkley for Michael Buxton of Manchester, which was due by my brother, and a letter
Jan 22 To Bullhouse, where I spoke with Capt Rich & acquainted him with a meeting of the officers of the Army at York on Tuesday.
Jan 24. … Then at noon Capt Rich came with me to Ernshaw's, where I spent 4d, & so came home
Jan 25. In the morning I called on Capt Rich at Bullhouse, where I stayed halfe an hower by reason of the great rayne that then fell. After, hee & I went to Cawthorn & called on Capt Shirt … Thence to Denby… then Wakefield were we stayed all night at the Mearemayd & spent 3s.
Jan 26. .. Rode by Methley boat & so to York, so we went back to our lodging & spent 3/6. This day Rich wife abused mee about the lone of an horse very basely, so that I rid on Ed Mitchell's meare to York & home again.
Feb 2. I went to Hornethwayte & carryed home Wm Rich his tow bookes.
Feb 6. ... thence to Thurleston, where Cpt Rich … met me, and after that, home at night. I spent 6d at Frances in Thurleston,
Feb 15. ... went to Bullhouse in the morning to speak to Capt Rich about passing our acct; & I allso wished him to borrow mee 20 l. (pounds) of his father, and to enquire of him whether hee was willing to buy Haslehead or not.
Feb 18. I went to Bullhouse this norne, but Capt Rich was not at home
Feb 19 ... Night, then I went to Bullhouse to Capt Rich, who told me his father was unprovided to deale with mee for the present; & after some other discourse about the auditing of our accounts, wee came together to the millne & parted.

About 9.30 Richard Hawkesworth & I rid to Hornthwayte & called on William Rich of Hornethwayte & went into & through Denby quarter & collected money of those whom wee mett and the rest promised to pay it to Rich & Hornthwayte before Sunday next; & parted at Gunthwayte Mill & promised to meet at Hornthwayt on Thursday for the same purpose; and so Wm Rich & I came homewards together & parted at his house & I came home at night.
Mar 4. I went to Hornthwayte; thence to Waterhall; then to Hornthwayte again, where was John Mickelthwayte & Richard Hawksworth, who with Wm Rich & mee came to Eclans; so to Bullhouse, where Capt Rich went with us through the town to gather money towards the 40 l. (pounds) for the vicar & we were denied only by Jo. Scott, Wm Haigh & Rich. France.

William was Master of the Penistone Hounds on 14 September 1647. He signed a will on 16 Aug 1648. William made a will dated 18 Aug 1648 at Penistone. His will mentions his wife Isabel, son Silvanus, younger son William and daughters Mary, Rebecca and Ruth.
I, William Rich of Bulhouse, gent. To Silvanus my son, my messuages lands, etc which I inherited of Emory Rich, father to me, and my son Sylvanus also estates left my will of sd father, in fee simple except a messuage in Thurlestone Mere called the Royd and except the lands etc thereto belonging, sd Silvanus paying to Mary Rich, my eldest daughter, Rebecca Rich, second daughter, and Ruth Rich third daughter 100 pounds each when 21.
To William Rich, son, in fee simple, my messuage in Thurlston Meare afsd, called the Royd, paying to Martha, youngest daughter 100 pounds when 21.
Sylvanus my son to have the tuition of sd William my son.
Residue one third to wife, one third to Mary my daughter, other third to Ruth & Martha my daughters equally.
Mary & Ruth my daughters to be executrices.
Isabel my wife to have the nether parlour & chamber over it at Bulhouse. Dated 18 Aug 1648, signed Wm Riche, Witness John Sotwell, John Hanson, Thomas Hanson.”
His will was proved on 18 July 1660 at the Prerogative Court of Canterbury and proved at London 18 July 1660 by Mary Rich, power reserved to Ruth Rich.
William died two years before the death of his father, Aymer. He was buried on 6 Mar 1650 in St. John's Church, Penistone, Yorkshire. "Sepulti Gulielmus Rich Gen. March 6."
He died about 1650 in Bullhouse, Thurlstone, Yorkshire. William was the son and heir but retained close ties with Denby and was certainly living at Denby Hall on 3 December 1628 when a conveyance in trust is recorded. During the Civil War William was a Captain under Lord Fairfax in 1644. He married Isabel and had six children. It is through his eldest son, Sylvanus (1627-1683) that the line continues and it was William's grandson Elkanah (1659-1724) who built the chapel at Bullhouse.

Daniel RICH was born about 1603 in Bullhouse, Thurlstone, Yorkshire. He was christened on 6 Nov 1603 in St. John's Church, Penistone, Yorkshire. He married Mary Haigh of Midhope. He leased property on 6 Jan 1624. "Aymor Rich of Bullhouse, co, York to Daniell Rich his 5th son. 1/3 part of a messuage and lands at Smallshaw in Thurleston meer in the tenure of William and Edward Fyrth and an undivided 1/2 part of another 1/3 part of the same messuage in the tenure of William and Thomas Gleadhill, from the death of Aymor Rich for 100 years at an annual rent of 12d to Aymor Rich's heirs." He married Mary Haigh, daughter of William Haigh on 24 June 1624 at Bradfield, Yorkshire He served in the military between 1642 and 1644. Daniel served under his brother William in the Parliamentary Army 1642. He is mentioned with William in Adam Eyre's diary in 1647 in a story about hunting. He bought and sold property in 1653/54 in Smallshaw and Thurgoland. On 24 Sep 1653. He was mentioned in a deed dated 8 Dec 1653. Settlement. Thomas Burdett, son of John Burdett, of Nether Denby, deceased, to John Blakeley of Gunthwaithe and William (Kirke) Rich of Stornessille. Daniel Rich Charles Usher He signed a will on 5 Mar 1676 in Penistone, Yorkshire. "In the name of God Amen the fifth day of March in the year of our Lord gpd I Daniel Rich of Smallshaw in the county of York being of perfect memory and remembrance praised be God for it I do make and ordain this my last will an testament in manner and form following: First I give and bequeath my soul unto the hands of Almighty God believing that I shall receive full pardon and free remission of all my sins and be saved by the precious death and merits of my blessed saviour Jesus Christ, and my body to the earth from whence it was taken to be buried in such Christian manner as to my executors hereafter named shall be though meet and convenient; and as touching such worldly estate as the Lord in mercy hath lent me; my will and mind is the same shall be employed and bestowed as here after by this my will is expressed and first I do revoke renounce frustrate and make void all wills by me formerly made; and I do declare this my last will and testament in manner and form following that is to say;

I give to my son in law Thomas Burdett and which he hath by his first wife fifty pounds and to be paid within two years after the decease of Daniel Rich the elder
I give to my daughter Lidia and to her children fifty pounds to be paid within two years after the decease of the aforesaid Daniel Rich and to be equally divided amongst them all.
And I do make my two sons Daniel & Emor my true and sole executors of this my last will and testament for to prove and pay all my debts and legacies; And I do revoke make null land void all former wills and testaments confirming this my last willl and testament with my hand and seal in the presence of those witnesses whose names are here subscribed the day and year above written. Witnessed by John Rich (his mark) and William Earnshaw (his mark)." He died on 6 Sep 1679 in Bullhouse, Thurlstone, Yorkshire. Rev Oliver Heywood states that Daniel Rich of Penistone parish, uncle to Sylv. Rich of Bullhouse, died Oct 1 1697 aged 76. Elizabeth RICH was born about 1605 in Bullhouse, Thurlstone, Yorkshire. Elizabeth married John Haigh who lived at Midhope Hall. He was born in about1600 at Midhope, Ecclesfield, Yorkshire.
John Haigh made a will dated 25 Nov 1645 at Midhope, Ecclesfield.
"Will of John Haigh of Middop yeoman - to be buried in church or churchyard of Bradfield - The sum of £50 remaining in hands of the childs part or portion of Mary Street be raised soon as possible & paid to my brother Wm. Rich in discharge of the sd £50 he being also charged with 3rd child's part. Above & funeral exp being paid, remainder to be divided into 2 parts
To my wife Elizabeth to have the one half in full satisfaction of all claims.
To John Hobson of Dodworth & Daniel Rich of Smallshaw my brother in law all my messuage in Silkston & lands thereto belonging now in occupation of John Swift to sell them to pay debts.
Wife to have the education & tuition of Jonas Strete. To sd wife messuage wherein I live & the several romes in the same & also half of the outhouse & lands thereto belonging, said Elizabeth paying four marks by the year in such manner & to much use so hereafter is expressed.
I make sd John Hobson & Daniel Rich exors. To said exors the other half of the outhouses and lands etc in Middop afsd to hold the one half in ? & the other half in reversion after death of my sd wife paying during the life of my sd wife the sum of 26/8 to such uses as hereinafter expresssed and after the death of sd wife the sum of 53/4 to such uses as hereafter expressed.
The sd yearly rent I give to be paid out of my lands afsd for ever for & in my discharge of a gift of 10 pounds given by widow Savage of Middop decd to be by me disposed to the uses hereafter mentioned.
To sd John Hobson & Daniel Rich a close in Langsett called the Royde paying to John Wainwright of Middop George Sanderson of the same Wm Cooke of the same & Thomas Hattersley of the same 4 pounds to be paid one half at Pentecost & the other at St Martin the Bishop, if twenty days in arrears then ?
I bequeath towards the maintenance of a preacher at Middop chapel ?

John's will was proved on 17 Jul 1652 at the Prerogative Court of Canterbury and proved in London 17 July 1652 by Daniel Rich the surviving executor.
